The application is for grant of bail.

After hearing the learned Counsel for the applicant to some extent and after going through the investigation papers I have shown my disinclination to grant bail to the present applicant.

Learned Counsel for the applicant seeks permission to withdraw the same with direction to expedite the trial and with liberty to file afresh after six months.

The applicant is arrested on 25/12/2021 and since then he is behind bar. The report of the District Judge shows that the case is transferred from one Court to another, and therefore, the trial is not proceeded. Another ground mentioned by the Ad-hoc District Judge-1 that the muddemal is not produced by the Prosecution, and therefore, the trial is held up though charge was framed on 20/09/2022. The CA report is placed before this Court

Considering the fact that the applicant is behind bar since last three years and there is no progress in the trial.

The application is disposed of as withdrawn.

The trial Court shall make every endeavour to expedite the trial and liberty is granted to the applicant to move before this Court for grant of bail after six months if there is no substantial progress in the trial. (URMILA JOSHI-PHALKE, J.) *Divya
