O R D E R

(Dated 09/12/2017) Appellant Nos.1 and 2, who are the original claimants are personally present before the Lok-Adalat. They state that the appellant No.3-Dilip Pandurang Revatkar has expired on 31st January, 2010. In support, a certificate issued by the concerned Registrar is produced before us. We have perused the same and we have no doubt about its authenticity. The copy of the death certificate is placed on record. Original death certificate is returned to the appellant Nos.1 and 2.

Shri Asghar Hussain, learned counsel for the appellant is present. Respondent no.1 is absent, Learned counsel for respondent No.2 Shri Hitesh N. Verma is present. However, Shri A.B. Vijaykumar, Manager of respondent No.2 is present. The appellants, who are the original claimants and respondent No.2 have amicably settled the dispute. They have filed on record terms of compromise. We have perused the same. The parties state that the terms incorporated in the compromise are acceptable to them and have been voluntarily entered into by them. The terms of compromise are signed by the appellant Nos.1 and 2 and respondent No.2 and so also their respective learned counsel. The parties pray that award be passed in terms of

compromise.

In view of above, the award is passed in terms of compromise Pursis and it be drawn up accordingly. The respondent No.2, shall deposit the amount of compromise within 45 days of the receipt of the copy of the award in the Claims Tribunal, Nagpur within 45 days of the receipt of the copy of award. The appellant undertake to furnish copy of the award to the respondent No.2 and on its receipt shall acknowledge the delivery of the award.
