This application is for grant of early hearing of appeal.

For the grounds mentioned in the application, case is made out to allow the same. Accordingly, Civil Application is disposed of, as allowed.

CIVIL APPLICATION (CAO) NO. 791 OF 2019.

This application is for striking off defence of applicant for non-compliance of order dated 29/08/2013, wherein appellant's counsel had made a

49CAO 791.19 statement of making payment of Rs.2,000/- per month towards interim maintenance, pending present appeal to respondent - wife.

Learned counsel for applicant submits that though, applicant had made payment of such amount, as on date, he is in arrears of Rs.8,000/- and undertakes to deposit said amount by adjourned date.

In that view of the matter, application is disposed of with a direction to appellant to pay Rs.8,000/- on or before the adjourned date, failing which applicant's defence shall be liable to be struck off.

By consent, S.O. to 03/09/2019 for payment of Rs.8,000/- and for final hearing.
