Heard Shri Anand Parchure, learned counsel for the petitioner and Shri D.P. Thakare, learned Additional GP for the respondent.

The learned AGP for the respondent state that the proposal forwarded has been rejected by the concerned department of the State Government.

According to Shri Parchure, learned counsel, this defence aggravates the contempt. He invites attention to the order dated 21.06.2017 passed in writ petition to urge that there unequivocal fact that the petitioner is entitled to advantage of stagnation has been brought on record. 5.
We have perused the order dated 21.06.2017 in Writ Petition No. 1447 of 2012.

We find that the learned AGP then has pointed out absence of instructions and was seeking time. 7.
In this situation, keeping all contentions of the petitioner open and with liberty to the petitioner to challenge the decision of the State Government on merits as per law, we dispose of the present Contempt petition with no order as to costs.
