By the present application, since the writ petition was dismissed on 07.03.2014, by this Court the amount of gratuity of Rs.23,423/- as deposited by the petitioner in this Court is requested to be remitted to the office of the Controlling Authority / Assistant Labour Commissioner, so that the respondent would be able to withdraw the same. By an order dated the 06.02.2020, the office was directed to verify the position in this regard. The Registry has reported that the amount as deposited by the petitioner, was invested in a fixed deposit with the Oriental Bank of Commerce, Main Branch, Nagpur, however, in pursuance to the Court order dated 07.03.2014, the FDR, was discharged in the sum of Rs.47,723/- and a demand draft in the above sum, in favour of Assistant Labour Commissioner, Bhandara was requested to be issued, for its disbursement. This is said to have been done on 17.04.2014. It is thus apparent that the

(2) 2.CAW.326.20 amount is no longer lying with the Registry of this Court. The respondent, therefore, ought to make necessary enquiry with the Assistant Labour Commissioner, Bhandara and apply for withdrawal of the amount, if not withdrawn thus far.
