Heard Shri D.S. Lambat, learned Counsel [Appointed] for the petitioner and Shri A.S. Fulzele, learned A.P.P. for respondents.

For late reporting, after enjoying parole leave by 18 days, a punishment of remission cut of 3 days for each day of late reporting has been imposed. According to the learned counsel for petitioner, the same is excessive.

Learned A.P.P. submits that absolutely no justification has been given and only story reported is

During hearing we find that the punishment has been imposed and now the proposal is pending before the District Judge.

We therefore, grant petitioner time of three weeks to make appropriate representation to the District Judge, along with necessary documents. If such representation is made, the District Judge may after going through the representation and documents, take suitable decision on the proposal placed before him.

With this liberty, we dispose of the Writ Petition. No costs.

Fees to be paid to the learned counsel [appointed] for the petitioner, is quantified at Rs.1500/-.
