The learned counsel for the petitioner submits that this petition is being filed for direction to the trial Court to decide the miscellaneous application before proceeding with the trial and recording the evidence, for registering an offence against the Police Officer and the concerned staff and to initiate the enquiry.

After going through the said application we find that the prayer made in the application is an independent prayer for registration of the crime for the allegations made in the application, which are otherwise nothing to do with the trial. Therefore, the prayer to stay the trial, till the decision on such application, cannot be accepted. However, it is expected that the trial Court shall decide the application before final decision in the trial.
