On allegation that, the accused persons in crime no. 1942 of 2021 registered on 23rd December, 2021 for the offence punishable under Sections 420, 467, 468, 471, 473 read with Section 34 of Indian Penal Code, the income tax returns documents which were furnished for obtaining home loan were fabricated one and on the basis of forged and fabricated documents loan was obtained.

Learned counsel for the applicant submits that even on the face of allegations made in the First Information Report, no role is attributed to the applicant in the alleged offence. It is submitted that applicant is falsely implicated in the alleged offence. SKNair

On the other hand, Shri Khan, learned Additional Public Prosecutor has strongly opposed the application. He points out from the case diary that statement of witnesses were recorded during the investigation.

After perusing the case diary and contents of the First Information Report, I am of the opinion that prima facie no material is there to show the role played by the applicant in the alleged offence. Moreover, one of the co-accused namely Amrapali D/o Vinod Raut was granted anticipatory bail by this Court on 15th February, 2022.

In the above referred backdrop, I am inclined to confirm ad-interim anticipatory bail granted on 25th January, 2022, the application is allowed. 6.

The order dated 25th January, 2022 is hereby confirmed.
