Heard Shri Patil, learned counsel for the petitioner and Shri Pathan, learned AGP for the respondents.
The petition is not in public interest. The petitioner is not in a position to show any injury to his legal rights. The submission of the petitioner is as he is dependent on ex-Army personnel, he is entitled to allotment of E-Class land. The encroachment is on Eclass land. The learned AGP states that the petitioner has not applied for allotment of land to the Collector and as such he does not possess any locus.
The facts pointed out to this Court and noted supra are not in dispute. Hence, whenever the petitioner applies for allotment of land and gets necessary locus, he can always point out to the Competent authority encroachment and seek its removal. With said liberty to the petitioner, writ petition is disposed of. No order as to costs. JUDGE JUDGE *GS.
