Heard Shri Samarth, learned counsel for the applicants/ petitioners and Mrs. Joshi, learned AGP for the respondents.

The learned AGP is seeking time to file reply to this Civil Application, however, no reply has been filed in main writ petition as yet though this Court granted last chance on 09.09.2014.

Shri Samarth, learned counsel submits that 97th Amendment to Constitution and consequential amendment in Gujarat Cooperative Societies Act, have already been quashed and set aside by the Division Bench of Gujarat High Court.

The grievance in Civil Application is proposed amendment to Bye laws have been denied because of said 97th Amendment. Hence, we allow the application. The necessary amendment be carried out within one

The respondents to file their reply to the contentions in main petition as also to amended portion within next four weeks by way of last chance. If the reply is not filed by then, the matter shall be proceeded further in default thereof.

List the matter on 11.03.2015.
