Shri Tekade, learned counsel for the petitioner points out that despite the fact that there was a conditional order for withdrawal of the amount passed by the Second Joint Civil Judge Senior Division, Akola dated 06/05/2023 on Exhs. 42, 45 and 47 the learned Executing Court allowed the application Exh.88 on 10/01/2024 permitting the respondent No.1 to withdraw the amount. It is submitted that he would withdraw the amount tomorrow.

Shri Tekade, learned counsel for the petitioner has further pointed out that in view of the said subsequent event the application for amendment is filed accordingly, the application is allowed.

The amendment be carried out before 19/01/2024.

Place this Writ Petition on 22/01/2024.

Till then, there shall be stay to the order dated 10/01/2024 passed below Exh.88.
