In the application filed by the applicant under Section 11(4)(b) of the Arbitration and Conciliation Act, 1996, it was prayed that a person be appointed as third arbitrator for presiding over the arbitral tribunal. Inadvertently, while passing the order, it is recorded that Shri A.P. Deshpande, former Judge of this Court is appointed to resolve the dispute between the parties. There is apparent error while passing the order which is required to be corrected.

Hence, clause (i) of the order passed on 29-07-2016 be deleted and substituted by the following clause:

"(i) Shri A.P. Deshpande, former Judge of this Court is appointed as Third Arbitrator to

2 cao97.17 preside over the arbitral tribunal to resolve the dispute between the parties."

The order passed on 29-07-2016 be corrected accordingly and certified copy of it be given to the parties without claiming any charges.

The civil application is allowed in the above terms.
