Considering the facts of the case and the fact that the respondent No.1 has retired after attaining the age of superannuation and till then has worked with the petitioner - Trust, the respondent No.1 is permitted to withdraw the amount of Rs.36,000/- deposited by the petitioner with the Registry of this Court alongwith interest on it, if any, on submitting undertaking to the Registrar (J.) of this Court that in case if it is found that the respondent No.1 is not entitled for the amount withdrawn by him, he will re-deposit it with interest as may be determined by this Court within two months. Civil application is allowed accordingly. No costs. JUDGE Tambaskar.
