Heard Shri V.B. Gawali, learned Advocate for the petitioner-original defendant.
The petitioner has challenged the order passed by the Trial Court allowing the application [Exh.33] filed by the respondent-plaintiff praying for appointment of Commissioner to submit report regarding the alleged encroachment. The learned Trial Judge has dealt with the relevant aspect in paragraph No.3 of the impugned order. I do not find any patent illegality or irregularity in the impugned order which necessitates interference by this Court in the supervisory jurisdiction. The petition is dismissed. In the circumstances, the parties to bear their own costs.
