Learned counsel for petitioner seeks leave to withdraw with liberty to take further appropriate steps after obtaining appropriate instructions. He submits that if advised petitioner may issue fresh notice also.

Learned A.G.P. appearing for respondent nos. 1 and 3 is opposing grant of such opportunity. 4.

Prayer in the petition is about lapsing of

Order 010217wp397.17 reservation under Section 127[1] of the Maharashtra Regional and Town Planning Act, 1966. The land has not been acquired till date and D.P. Reservation is of the year 2001. Thus, cause of action is continuous. Hence, with liberty to petitioner to take appropriate steps as per law, we dispose of the Writ Petition as withdrawn. No costs.
