OCTOBER 13, 2025 1) The present petition is directed against the order dated 06/10/2023 passed by the Sub-Divisional Officer, Brahmapuri, District Chandrapur, whereby the authority has condoned the delay of 11 years and 04 months.

2) I have gone through the order passed by the SubDivisional Officer and find that the Sub-Divisional Officer had not recorded any reason for coming to the conclusion to condone delay. It is clear that no reasoned order was passed, therefore, it is necessary to set aside the order and remit back to the SDO to decide it afresh.

3) In view thereof, the petition is allowed. The order dated 06/10/2023 passed by the Sub-Divisional Officer, Brahmapuri, District Chandrapur, is hereby quashed and set aside.

4) The matter is remanded back to the Sub-Divisional Officer to decide it afresh by giving an opportunity of hearing. KOLHE

2 32-wp 461.2024.odt 5) It is expected that learned Sub-Divisional Officer shall record reasons on the delay application and pass an appropriate order within a period of two months.

6) The parties are directed to appear before the learned Sub-Divisional Officer on 03/11/2025.
