The State of Maharashtra has filed this application under section 5 of the Limitation Act, 1963 seeking condonation of delay of 87 days in filing the appeal against the judgment and decree passed by the first Appellate Court.

The learned counsel appearing for the respondents has no objection considering the meagre delay.

In view thereof and for the reasons set out in the Application, the Civil Application is allowed as prayed. The Second Appeal be registered and processed in accordance with the Rules.
