Joshi, counsel for the petitioner. Shri N.R. Rode, A.G.P. for the R-1 to 3.

CORAM : SMT. VASANTI A. NAIK AND A.S. CHANDURKAR, JJ.

DATE : SEPTEMBER 16 , 2015.

By this petition, the petitioner seeks a direction to the respondent nos.2 and 3 to expedite the recovery proceedings against the society.

According to the petitioner, though a recovery certificate was issued in favour of the petitioner in the year 2013, the respondent nos.2 and 3 have not executed the same as yet. Shri Rode, the learned Assistant Government Pleader, on instructions from the respondent no.3-Tahsildar, who is present in the Court, today, states that the recovery certificate would be positively executed within a period of six months. It is stated that a tedious procedure is required to be followed for execution of the recovery certificate.

By accepting the statement made on behalf of the respondent no.3-Tahsildar, which would be binding on the respondents, we dispose of the writ petition with no order as to costs.
