DATED : FEBRUARY 6, 2020 Heard Mr. Bhise, learned counsel for applicant and Mr. Rode, learned A.P.P. for non applicant-State. Applicant is arrested in connection with Crime No.441/2018, registered with Police Station, Akot, Dist. Akola for an offence punishable under Sections 406, 420, 467 and 34 of the Indian Penal Code.

The learned counsel for applicant would submit that this Court has already granted pre-arrest bail in favour of co-accused Wasim against whom allegations of identical nature are levelled.

Admittedly, co-accused Wasim who was also middleman just like the present applicant is granted prearrest bail on 13.01.2020 and while granting him bail, this Court has already discussed case of applicant in detail. The learned A.P.P. would submit that the case of the present applicant and co-accused Wasim is at part.

ba63.20.odt In that view of the matter, the reasons stated in order dated 13.01.2020 passed in Criminal Application (ABA) No.852/2019 are aptly applicable in the present case. Moreso, there is no criminal antecedents against the present applicant, investigation is also almost over and only filing of charge-sheet is remained to be done. That leads me to pass the following order.

ORDER

(i) The application is allowed.

(ii) Applicant Shaikh Bashir alias Buddha Shaikh be released on bail in connection with Crime No.441/2018, registered with Police Station, Akot, Dist. Akola for an offence punishable under Sections 406, 420, 467 and 34 of the Indian Penal Code, on he executing P.R.Bond in the sum of Rs.25,000/- with one solvent surety in the like amount. (iii) The applicant is directed to attend Police Station, Akot City, thrice a month i.e. on first, second and third Monday of each month between 11.00 a.m. to 05.00 p.m. for next six months The application is disposed of.
