Perusal of report of execution of bailable warrant issued against the respondent would reveal that the same could not be executed as the respondent is reported to be dead.

The prosecution along with the report has also placed on record death certificate of the respondent Suresh Narayan Bankar, issued by the Municipal Council, Yavatmal. The document, as such, establish fact of death of the respondent.

The appeal against the sole respondent is thus abated and be removed from the board.
