DATE : February 22, 2017 The applicants seek permission to withdraw the amount of compensation deposited by the appellant. It is submitted that the appellant has disbursed compensation at the rate of Rs.750/- per square meter for the acquired lands in other proceedings from the same village. This fact is not disputed by the learned counsel for the appellant. In the circumstances, the claimants are permitted to withdraw seventy percent (70%) of the amount of enhanced compensation, subject to filing an undertaking that in case the appeal is allowed, said amount will be repaid with interest at such rate the Court may direct.

Civil Application is allowed and disposed of. JUDGE Andurkar
