This application is fled by appellant wife seeking condonation of delay of 22 days in fling the Family Court Appeal challenging the common judgment and order dated 30.08.2018 passed by the Family Court No. 4, Nagpur in Petition No.A-609 of 2012 and Petition No.A-1435 of 2017, thereby allowing the petition of respondent husband for dissolution of marriage and dismissing the petition fled by the appellant wife for restitution of conjugal rights. The respondent husband after service has fled reply opposing the said application and prayer made therein.

We fnd that delay is satisfactorily explained in the application, hence the application is allowed. The delay of 22 days in fling the Family Court Appeal is condoned. The civil application is disposed of.

Issue notice to the respondent, returnable in four weeks. In addition to regular mode of service, private service is permitted, as per the Rules.
