After hearing learned counsel for the applicant to some extent and after going through the investigation papers, I am not inclined to grant bail to the present applicant, considering the commercial quantity is involved. 2.

Learned counsel for the applicant seeks permission to withdraw the same with the liberty to file after six months if there is no substantial progress in the trial. 3.

He submitted that, on various occasions, the trial court has issued the summons but witnesses are not remaining present, and the investigating officer is also not taking the efforts to secure the presence of witnesses, and therefore the trial has not progressed.

Considering the submission, the trial court shall make every endeavor to secure the presence of the witnesses. The prosecution shall take effective steps to rkn

Permission is granted to withdraw the application with liberty to file the application after nine months if there is no substantial progress in the trial. 6.

The criminal application is disposed of as withdrawn.
