DATED : 25-04-2017 After hearing this matter for sometime, the learned Counsel for the applicant seeks leave of the Court to withdraw the application with a direction to the trial Court for expeditious disposal of the case and also alongwith liberty to file a fresh bail application, if the trial is not concluded expeditiously.

Leave with liberty as prayed for is granted.

It is directed that the trial of the applicant and others in this case shall be concluded as expeditiously as possible and the provisions of Section 309 of the Criminal Procedure Code shall be followed in concluding the trial, preferably within four months from the date of receipt of this order by the trial Court, considering the fact that the applicant is an under trial prisoner. In case the trial is not concluded within the time stipulated by this order, the liberty is given to the applicant to file a fresh bail application before the trial Court on the ground of delay of trial and also on other grounds, available under the law.
