After hearing learned counsel for the parties, to achieve the substantial justice in the present matter, it would be useful to direct the learned Magistrate to dispose of Criminal Application No.38/2010 filed by learned counsel for the present petitioner before the learned Magistrate, Ashti under Section 125 of the Cr. P. C. for maintenance, within one month from the of receipt of this order.

With these observations, Criminal Writ Petition No. 70/2015 is dismissed.
