Heard Shri B.W. Patil, learned Counsel for the applicant-appellant. Nobody appears on behalf of respondent no.1, though duly served.

Learned Counsel for the appellant has invited my attention to the reasonings stated in paragraph 15 of the impugned judgment and order. The reasoning given by the learned Magistrate for holding the sole respondent as not guilty appears to be raising debatable questions and, therefore, I am of the view that this is a fit case for grant of leave to file an appeal.

Accordingly, leave to file appeal is granted. The application is allowed and disposed of.
