Adv. Kilor appearing for applicants has produced a communication dated 28.02.2017 sent by respondent no.3 to applicants. It is taken on record as Exh."X". In view of said communication, Adv.Kilor seeks leave to withdraw. 3.

Learned Public Prosecutor for respondent no.1- Mr Samir Mallik for respondent no.3 have no objection. Adv. Bhandarkar appearing for intervenor also has no objection. 4.

Accordingly, in view of Exh.'X' we dispose of the Application as not pressed.

Adv. Kilor seeks leave to withdraw the amount of Rs. 20 lakhs deposited with the Registry of this Court in terms of order dated 5th October,2016. He points out that nobody appeared for

03.03.apl.46.16 non-applicant/respondent no.2 on 5.10.2016. Even today, there is no appearance for respondent no.2.

Other parties have no objection if amount is allowed to be withdrawn. Accordingly, we permit the applicants to withdraw the amount deposited with it, with interest accrued thereon. JUDGE JUDGE sahare
