Heard Shri R.J. Shinde, learned counsel for the applicants, Shri J.Y. Ghurde, learned APP for non-applicant No. 1 and Shri Anand Deshpande, learned counsel for nonapplicant No. 2. Perused agreement dated 07.11.2015 entered into by present applicants with original owners. The complainant who is respondent No. 2 has claimed possession and, therefore, pointed out theft. Reply filed by the Investigating Officer also shows that during investigation non-applicant No. 2 (complainant) was found in possession.

In this situation, without observing anything on merits of the controversy and with liberty to the present applicants to take such other steps are are open in law, we dispose of the present proceedings. No order as to costs. JUDGE JUDGE *GS.
