The applicant is seeking pre-arrest bail in crime registered against him for the offences punishable under Sections 306, 498-A read with 34 of the Indian Penal Code.

The allegations against the applicant are that his wife deceased Savita has committed suicide because of ill-treatment meted out to her as applicant has illicit relationship with some other lady.

2 aba37.16 The marriage between applicant and deceased Savita took place 35 years ago. The applicant aged about 60 years is an Agriculturist and is president of a Society administering the school. The applicant had not been involved in any crime, earlier. This Court granted ad-interim protection by the order dated 21 st January, 2016. It is not the case of the non-applicant that the applicant has misused his liberty. Therefore, the following order:

In the event of arrest of applicant in Crime No.6/2016 registered by the non-applicant, the applicant shall be released on bail on furnishing P.R. bond in the sum of Rs.10,000/- with one solvent surety in the like amount. The application is allowed in the above terms. In the circumstances, the parties to bear their own costs. JUDGE Tambaskar.
