After hearing learned counsel Shri S.P.Bhandarkar for the applicant in extenso and when the Court was not inclined to pass any orders in favour of the applicant, learned counsel submits that permission be given to the applicant to withdraw the present application. He further submits that the applicant be permitted to file an application for discharge before competent Court.

The prayer is accepted.

The criminal application is disposed of as withdrawn with liberty to the applicant to file the application for discharge before competent Court.

If such application is moved by the applicant, it is expected from learned Judge below to decide the same in accordance with law.
