The appellant Maharashtra State Regional Transport Corporation (MSRTC) Nagpur has challenged the judgment dated 28/09/2010 passed by the learned Member, Motor Accident Claims Tribunal-3, Nagpur in MACP No.370/2007.

Heard Shri V. H. Kedar, learned counsel for the appellant and Shri Asghar Hussain, learned counsel for respondents. 3.
Shri Kedar, learned counsel for the appellant has placed on record the pursis signed by the Law Officer Shri Rohit M. Kashyap who is present before the Lok-Adalat and duly authorised by the Divisional Controller, S. T. Nagpur, to withdraw the present appeal unconditionally. 4.
In view of the aforesaid pursis, the present appeal is disposed of as withdrawn.

The appellant is permitted to deposit balance amount of compensation within a period of six weeks from today in the registry of this Court. The respondents are granted permission to withdraw the same. 5.
In view of above the first appeal is disposed of as withdrawn. 6.
Court fees be refunded as per the Rules.
