Criminal Application (APPA) No.51 of 2017 Heard learned counsel for the applicant and learned Additional Public Prosecutor for non-applicant. Issue notice to the non-applicant.

Learned Additional Public Prosecutor waives notice.

This application is for suspension of sentence impose upon applicant and for bail contending that applicant was on bail, pending trial and his sentence is suspended by the Trial Court, pending appeal. It is found that the applicant is convicted for .....2/-

the offence punishable under Section 354 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act and is sentenced to suffer rigorous imprisonment for three years and to pay a fine of Rs.500/-, in default, to suffer rigorous imprisonment for one month.

Considering the fact that applicant was on bail and is stated to have paid amount of fine and his sentence is suspended by the Sessions Court till filing of the appeal, the application is allowed, as per order below:

The applicant shall be released on bail on his executing P.R. Bond in the sum of Rs.15,000/- with one surety in the like amount.

While on bail, the applicant shall attend Police Station Officer, Police Station Asegaon Purna, Taluka Chandur Bazar, District Amravati quarterly on first day of each such month, pending appeal. Hamdast is allowed.
