1] This matter is heard for sometime.

2] The learned Advocate for the petitioner submits that he would move an application before the Appellate Court, which has passed the impugned order in Misc. Application No.31/2019, invoking Section 148 of the Code of Civil Procedure for seeking enlargment of time since he will positively deposit the amount of Rs.50,000/- before the said Court on or before 15.02.2020.

3] In view of the above, this petition is disposed off as withdrawn. If the applicant files such an application within 7 days from today, the Appellate Court would consider the said application, subject to the contentions of the litigating respondents, on its own merit. (Ravindra V. Ghuge, J.) NSN
