The applicant has sought to condone the delay of 651 days in filing the restoration application and has further prayed for restoration of the appeal, which was dismissed for non-filing of paper-book. Learned Counsel for the applicant states that paper-book will be filed within a week.

Having considered the reasons stated in the application, the delay is condoned subject to payment of costs of Rs.2,000/- (Rupees Two Thousand Only) to be paid to the High Court Bar Association, Nagpur. The appeal stands restored.

Both the applications stand disposed of accordingly.
