The allegation against the present applicant is that he had instigated the co-accused in committing the offence registered against him and other persons. The person, who carried out the assault by means of a sword, Shaikh Akil, has been granted bail by this Court in Criminal Application (BA) No. 319 of 2016 on 10/5/2016. The applicant is, therefore, entitled to be released on bail on the ground of parity. Hence, the order.

The application is allowed.

It is directed that the applicant be released on bail on his furnishing a P. R. Bond in the sum of Rs.25,000/- together with one solvent surety in the like amount on the conditions that the applicant shall attend the Court on the dates fixed in the matter regularly, shall cooperate with the Court for disposal of the case and shall not tamper with the prosecution witnesses.
