Heard both the sides.

Appellant No.2 expired on 09/03/2020. The copy of death certificate is annexed. Due to COVID restrictions, the applications could not be moved in time. Right to sue survives. The delay caused in filing applications for setting aside abatement and for bringing the legal heirs on record needs to be condoned.

Hence, all the applications are allowed. The names of applicants be added in place of appellant No.2 by carrying out amendments. Amended copy be supplied to other side.

The matter be kept on 7th September, 2021.
