The State has filed appeal under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 to challenge the order passed by the learned Additional Sessions Judge by which the pre-arrest bail is granted to the respondent / accused and it is directed that in the event of arrest in connection with Crime No.190/2018 registered with the present appellant for offence punishable under Sections 376, 313, 34 of the Indian Penal Code and Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act 1989, he be released on bail. During the pendency of this appeal, the respondent alongwith co-accused had filed Criminal Application (APL) No.1076/2018 under Section 482 of the Code of Criminal Procedure praying that the F.I.R. lodged against them by the informant be quashed.

Learned A.P.P. has produced copy of

2 apeal54.19 judgment passed by this Court on 6th February, 2019 by which the F.I.R. lodged against the appellant and co-accused is quashed. Learned A.P.P. has submitted that in view of quashment of the F.I.R. this appeal is rendered infructuous.

In the above facts, the appeal is disposed as infructuous.
