This is an application filed on behalf of applicant/respondent No.1 Sau. Sulochana Haribhau Jadhao for withdrawal of the amount deposited by appellant-Vidarbha Irrigation Development Corporation. 2.

Heard learned counsel Shri R.J. Mirza for applicant/respondent No.1, learned counsel Shri Vinay Dahat for the appellants, and learned Assistant Government Pleader Shri I.J. Damle for respondent Nos.2 and 3.

After hearing learned counsel for the parties, this Court is permitting applicant/respondent No.1 to withdraw 75% of the amount deposited by the VIDC before this Court. 50% of the amount is permitted to be withdrawn by applicant/respondent No.1 on furnishing the solvent surety/security to the satisfaction of the Registrar (J.) of this Court while 25% of the amount is permitted to be withdrawn by giving an undertaking to this Court that in the event if the appeal is allowed, she shall refund the amount along with the interest that will be determined by this Court at the time of final hearing. 4.

The civil application is disposed of.
