Heard learned Advocate for the appellant and learned Advocate for respondent No. 1. Perused the application.

This is an application for speaking to minutes. It is pointed out that an amount of Rs.4,00,000/- with accrued interest was already deposited as per order dated 31.07.2012. It is stated that the respondents are entitled to get the accrued interest on the said amount. 3.

On the date of the order the advocates for the parties did not point out this fact. In terms of the order dated 24.08.2023 the respondents would be entitled to get total compensation of Rs.8,00,000/- without interest.

2 13.caf.272.2024 However, in view of the deposit of Rs.4,00,000/- the appellant would be required to deposit the balance amount of Rs.4,00,000/-. The respondents are entitled to get the accrued interest on the deposited amount of Rs.4,00,000/-. In view of this, the application is allowed. The order dated 24.08.2023 is modified. The following para be added after last para of the order:

'6.

The respondents shall be entitled to get the already deposited amount with accrued interest. The appellant shall deposit the balance amount of Rs.4,00,000/-."

Necessary modification be carried out in the order dated 24.08.2023 and modified order be uploaded, accordingly.

The civil application stands disposed of, accordingly.
