The application filed under Section 156(3) of the Code of Criminal Procedure, 1973, is under challenge.

The learned counsel for the petitioner submits that, after passing of the order under Section 156(3) Cr.P.C., the First Information Report was registered, investigation was carried out, and the charge-sheet was filed. He further submits that during the pendency of this petition, the investigation was not properly conducted and there are several lacunae in the investigation.

Considering the fact, that the chargesheet has been filed, the appropriate remedy lies elsewhere. Hence, the present Petition is disposed of. [ M.M. NERLIKAR, J ] Piyush Mahajan
