In view of the orders passed by this Court on 13/12/2016 in W.P.No.6366/2016,second petition raising very same contention is misconceived. There is no change of circumstance also. The departmental enquiry is still going on.
In this situation, we are not inclined to intervene when the departmental enquiry is pending. Thus, in view of earlier orders and as departmental enquiry is pending, we dispose of the Writ Petition.
Needless to mention that all contentions raised by petitioner are kept open and can be pressed into service by him if any adverse orders are passed against him after departmental enquiry.
