We deem it appropriate to dispose of the petition with an observation that we disapprove the conduct of the Chief Executive Officer of the respondent no.3 - Nagar Panchayat, Aheri in the matter of cancellation of the E-tender after the technical bid of the petitioner was opened that too for unreasonable cause.

However, we refrain ourselves from causing interference in view of absence of fresh contract in favour of the petitioner.

The petition is accordingly disposed of. No costs. 4.

Needless to clarify that it shall be open for the petitioner to participate in fresh tender process. 5.

Counsel for the respondent no.3, on instructions, submits that the last date for submission of tender is to be extended by a period of one week from today. The statement is accepted.
