The writ petition was called in the morning session but, the petitioner was not represented by a counsel. None appears for the petitioner in the afternoon session also. Shri Shiralkar, the learned counsel for the respondent no.2 raises a preliminary objection to the tenability of the writ petition. It is stated that the petitioner has an alternate efficacious remedy of filing an original application before the Maharashtra Administrative Tribunal under Section 19 of the Administrative Tribunals Act. It is stated that the petitioner has approached this Court without availing the alternate remedy.

By upholding the preliminary objection raised on behalf of the respondent no.2, we decline to entertain the writ petition. The writ petition is disposed of with no order as to costs. The points raised in the petition are kept open. JUDGE JUDGE APTE
