The applicant is seeking pre-arrest bail apprehending arrest in crime registered against him for the offence punishable under Section 384 and 387 of the Indian Penal Code.

The accusations against the applicant are that he extorted money from the complainant (Government officer) threatening him of making complaint against him for the irregularities and

2 aba39.16 misappropriation of amount in Kanyadan Yojna, Motor Driving Yojna and Magaswargiya Gruha Nirman Yojna etc.

The application is opposed on the ground that the applicant is involved in similar crimes earlier.

The contention of the applicnat is that earlier he had filed complaint against the erring Government officers pursuant to which enquiry was conducted and it was found that there was substance in the complaint.

Considering the nature of accusations and the facts on the record, I am of the view that the interim order granted by this Court on nd January, 2016 is required to be confirmed, however, on certain conditions.

Hence, the following order:

(i) In the event of arrest of applicant in Crime No.562/2015 registered by the non-applicant, the applicant be released on bail on furnishing P.R. bond for Rs.10,000/- (Rs. Ten Thousand Only) and one solvent surety in the like amount.

3 aba39.16 (ii) The applicant shall attend the police station Frezarpura, Amravati on every Tuesday between 11 a.m. to 1 p.m. till the charge-sheet is filed.

(iii) The application is allowed in the above terms. JUDGE Tambaskar.
