Shri Agrawal, learned Counsel appearing for the respondent No.3 on instructions submits that for a period of 10 days no further steps would be taken pursuant to the order passed by the Executive Magistrate, Gondia on 04.01.2023 for taking possession of the mortgaged property. 2.

In the light of the aforesaid statement, the petitioners are at liberty to invoke the appropriate remedy for raising a grievance against the aforesaid order and also against the respondent Nos.1 and 2 in accordance with law. 3.

Accordingly, it is directed that till 05.02.2023 the respondent No.3 shall not take further steps based on the communication dated 04.01.2023. Keeping the points raised in the writ petition open, it is accordingly disposed of. No costs.
