The applicant has invoked the Arbitration clause by approaching this Court for appointment of an Arbitrator in terms of Section 11 of the Arbitration and Conciliation Act, 1996.

In pursuance of notice the non-applicant has appeared in the Court. The parties have settled the dispute out of the Court by arriving on certain terms of the settlement.

In view of that, both have made a joint request to dispose of this application by taking on record the terms of settlement. The terms of settlement which are annexed to the joint Pursis are marked as 'Article A' for identification and same are accepted and shall be treated as an undertaking given to this Court. 4.
