This is an application for regular bail.

At the time of hearing, learned Additional Public Prosecutor Shri V.A. Thakare for the State submitted that during the pendency of the application, the investigating officer has filed charge-sheet before the Court of law. Though jurisdiction under Section 439 of the Code of Criminal Procedure is concurrent, time and again this Court has asked the applicant to approach firstly before the Trial Court.

Learned counsel Shri M.N. Ali for the applicant submits that he wishes to withdraw the present application with a liberty to file an application afresh before the Trial Court. 4.

The criminal application is disposed of as withdrawn with liberty to the applicant to file an application afresh before the .....2/-

It is made clear that the case of the applicant is not heard on its merits at all by this Court.
