We find that the present criminal application filed by the applicants is premature. The proceedings are of summary nature and looking to the nature of offences, which are complained of against the applicants and since the learned Counsel for the applicants has expressed a worry that all the Directors of the Company will have to appear before the Magistrate, we think the
1602apl51.15 2/2 following order would subserve the interest of justice:
Order Criminal Application No.51/2015 is not entertained. The applicants are at liberty to apply for grant of exemption from personal appearance before the Magistrate. In view of nature of offences and summary procedure contemplated, the application for exemption from personal appearance, if filed, should be considered according to law. The applicants can appear through their Counsel in that event. The trial Court to proceed further.
