MARCH 7, 2016 This writ petition was heard in the morning since the Coordinate Bench had directed placement of this writ petition before this Court by order dated 05.02.2016.
Today, in the morning session, the learned counsel for the parties made a statement that they have arrived at a compromise and would like to file minutes of the order. Accordingly, at 1.27 p.m., they have filed minutes of the order. They are taken on record and marked "X" for identification. The minutes of order shall remain part and parcel of the record. Looking to the contents of Minutes of Order, it appears that respondent no.1 has agreed to give up the back wages of 50% as ordered by the School Tribunal subject to his pension case being
wp521.14 forwarded and finalised within a reasonable time. The Minutes of Order are, therefore, accepted. As stated in paragraph 4 of the Minutes of Order, the petitioner-Management shall send pension case papers of the respondent no.1, minutely and correctly prepared without any possible objections, within a period of two months from today. The Education Officer (Secondary), Wardha shall, upon receipt of papers of pension etc., shall expeditiously consider the pension case and other benefits to be given to the respondent no.1 and in any case shall not take time more than three months from the date of receipt of the papers from the Management. In view of above, Writ Petition No.521/2014 is disposed of. No order as to costs. JUDGE kahale
