The applicant is in custody since 21.1.2019.

The applicant is prosecuted for offence punishable under section 307 of the Indian Penal Code read with section 304 thereof. The bail is sought primarily on the ground that the applicant is in custody since long, that there is variance between the statements of the witnesses and an early trial is a remote possibility.

I have perused the statements and the medical papers. Considering the manner in which the assault allegedly occurred, I am not inclined to grant bail at this stage.

The trial Court is requested to fix the trial programme within seven days and to make an endeavour to complete the trial in the next three months. If there is no substantial progress in the next three months, the applicant shall be entitled to apply for bail, afresh.
